For those aboard Citation, however, the infraction represents a setback of nearly $1 million.The vessel's anglers had been participating in the 52nd annual Big Rock Blue Marlin Tournament, June 11-19 off North Carolina. Andy Thomossan landed what was by far the biggest fish: an 883-pound marlin, a tournament record.
The team on Saturday was declared winner of the prestigious competition, and there was plenty of celebration.
However, there also was a post-event lie-detector test, after which it was revealed that one of the hired crew did not possess a valid fishing license, available in North Carolina for only $15, or $30 for non-residents.
That was a violation of tournament rules and after lengthy deliberation, according to Evans Kistler of the Carteret County News-Times, tournament officials late Tuesday disqualified the catch and and denied the Citation team the winning purse.
End of celebration.
"No record. No money. No fish. No nothing. Yep, it's a nice ending to the story isn't it?" Thomossan told the Jacksonville Daily News. "He failed to get a fishing license, but we didn't know it. He told us he had it. He didn't. So you take a man at his word, you know?"
That man is Peter Wann. According to the state's fisheries division, he went out and bought a license after the catch of the monster marlin, bringing more shame to his team. He'll be fined $35 and ordered to pay court costs totaling $125.
The new winners are those who fished aboard the vessel Carnivore and caught the second-largest marlin, weighing 528.3 pounds. They net a grand total of $999,453.
Michael Topp, one of Citation's owners, figured the tournament board would not rule in Citation's favor.
"I think the Big Rock committee is doing what they have to do," he said. "I understand that. I'm a retired colonel. I know about rules."

If one of the owners was a retired Colonel then he should known that you have to do a hands on visual check of all required equipment/documents prior to departure. A basic rule we all seem to learn the hard way. Especially in a million dollar tournament. Why leave anything to chance????

The state of North Carolina requires all saltwater fisherman to possess a license (tax). Not the owners responsibility to check the crew, its the captains responsibility.

How does the fact that a hired hand working on the boat, not having a license, have ANYTHING in the world to do with Angler Andy Thomossan catching and landing that winning monster. Give it back to them.
As far as the previous comment , I don't see anywhere in the artical that said he, Peter Wann, was a fisherman. He was just crew the way I read it.
I don't know anything about deep sea fishing but was he actually still in North Carolina waters when he caught and landed the fish or was he far enough out to sea to be considered international and then just brought it back to the weigh in for the tornament.
Just maybe Peter Wann did not even need a license depending on where it was caught.
Does this mean that every guy in a pleasure boat with a fishing pole is in violation of some DEC law if everyone on board his boat doesn't have a license? What about his young children that may not be old enough to be licensed but are " working " helping keep the boat clean, getting dad a beer out of the cooler or maybe more bait.
A catch 22, not old enough to be licensed but everyone on board needs to be. That's a good one.

I'm no expert on fishing license law, but I would figure that if you don't have a fishing license in state waters that require one, then you're doing so illegally, thus voiding your qualification for any prizes available in the fishing tournament.
As for why you may need a fishing license in the first place... Some states require saltwater and/or freshwater fishing licenses. Usually they do this to raise more revenue for their state. I'm not sure about each state, but at least here in Florida, the money used from fishing licenses is appropriated to the Fish & Wildlife Research Institute for fishing conservation efforts.
Think about it this way: if some Joe Schmoe (recreational fisherman) is out there and doesn't know what he's doing, like keeping fish that are too small/young or improperly disposing of his fishing line, then he can negatively impact fishing populations. Multiply that with whole populations of people, and you can kill local fish populations fast, which is obviously a big deal, esp. for a state that depends on tourism and fishing.

I really think that they shouldn't have denied the WHOLE crew of such an achievement. At least they should've gave the record to them, maybe not the purse because yes, it is illegal to be out there without the license, but come on!! That fish is huge and not many other people would come even close to it!

YEa thats NOrth n south carolina for you. Theyare intense about their fishing and game restrictions. A fish and game officer has more power than any other law officer in the state. They can enter you house with their guns loaded and drawn without a warrant if they expect any kind of fish or game foul play. They take it a bit more seriously than other states so this doesn't surprise me at all.

It does not matter what or whose waters the fish was caught in. The tournament rules are what counts because they govern the payout. The captain should have had a meeting with his crew and made sure everyone had the correct credentials for the tournament. I have been fishing billfish tournaments for over 20+ years and we make sure everyone on the boat esp. the rookies have everything in order and go over the rule & regs twice before the baits hit the water. When you consider the money everyone spends to enter and fish the tournament it was the right ruling. Byron - Thanks for the info that he was first mate - seems that that would imply he had the experience to know of past turny rules. The fact that he was not just someone they grabed off the docks to mop the deck was not mentioned.
So I would even excuse the captain and/or owner in a case like that except for the part of simply asking, "Hey - got your license with you pal ?" LOL - that does seem pretty easy.
But - NOW - where were the turny officials - couldn't they have just looked up his name at sign-in on a computer and said, "Whoa buddy, fork over your license fee before climbing aboard.
OK - so he attempted to or did buy his license via the on-board computer - how tough are the turny rules - did Pete need the license before leaving the dock - before hooking the first fish - before landing the first fish?? Can't imagine that that was the first fish they hooked so it was probably catch and release until you got the one you wanted to bring back.
What would have become of it had they not had the winning fish - the would have competed for the entire turny and no one would have been the wiser.

there was also speculation the fish wasnt caught during the tournament due to the blackish color of the fish from what ive heard no official word as far as i know whether they kept investigating that or just pursued the citation because they knew that alone would disqualify them

I was on a boat that caught a marlin once. Small in comparison though it was, it changed color by the time it was on the boat. As the fish died, so did its glow. It was so sad. No amount of ice is going to stop that. Its got to do with the fish dying. Actually its like the soul departing....What a waste of a life. Very cruel to witness. Turned me off fishing. Marlin really are beautiful creatures.

The only other speculation was the fish was hooked outside of designated waters, this was dismissed when another boat that was within 200 feet of the Citation said he was in proper waters.

there was that speculation there was also the speculation it was caught the day before by another vessel who was not entered into the tournament, there is currently speculation on the 3rd place now 2nd place boat that their fish was caught outside of designated water into virginia but nothing has been finalized on that.

Actually no, it is not both. It is pure coincidence. Irony implies a reversal of predicted outcome based on circumstance. In this case, based on the name alone, one would imply that the predicted outcome, again based solely on the name of the boat, would be that of a citation for the crew. The fact that they did get a citation was coincidence since it happened to coincide with the name in relation to the actual outcome. I am a college English professor and as such have enough free time ponder stupid crap like this. Plus, I think this stuff is fun.

bb2dp is exactly right, in this case the name 'Citation' is actually in reference to a good thing: In NC if you land a fish above a certain size (i.e. a flounder over 6lbs.) and get it weighed at an official weigh station, the state will send you a certificate of achievement... which they call a citation.
I hope that settles it!

You think the new laws that charge for sport fishing in the ocean is generating revenue for that and not going to the coffers of government for other uses. ( Buy the way that was why Florida initiated not for enhancing salt water fishing but to bail them out!) Then you are not only the sad and lonely guy but a fool. For decades the courts would not allow it, until they got padded with judges that will bend to the will of the politicians. No where did I ever say that I don't buy my licenses, I just don't believe that the ocean should be marketed while companies like Gortons, ahnd the international fleets that rape our castline of fish.I have seen the devastation by the international community on our coasts. I have watched the east cast lose cod,flounder, mackral to name a few that were abundant and right at the shoreline in my time to nothing for 10 miles out.. So get in your little rowboat and go harass the people out there so you can feel important but to 90% of the true sportsman guys like you are a joke! If you did meet me out there with your attitude, you would not be happy. Your just a fool that thinks he is more important than you really are. For someone who claims 22 years as a fish and wildlife officer it is you that does not have a clue. I just would like to see families enjoy the true American way of life that we all had at one time before a buck was attached to it. The Pitman-Robertson Act was unique all the money had to go to wildlife management, that is where orkneymoor gets paid wether he knows it or not. Unfortunately, mictour is again misinformed, or wrongly opinionated I am not paid through the Pitman-Robertson Act, nor does all the money from the Pitman-Robertson Act have to go to wildlife management.
"The Pittman-Robertson Wildlife Restoration Act authorizes the Secretary of the Interior to cooperate with the States, through their respective State fish and game departments, in wildlife-restoration projects. However, per statute, no money apportioned under this chapter to any state shall be expended until the state in question assents to the provisions of this chapter and has passed laws for the conservation of wildlife, which includes a prohibition against the diversion of license fees paid by hunters for any other purpose than the administration of said state's fish and game department. The Act also provides for grants for hunter education programs and a mechanism for a multi-state conservation grant program."
The point of this blog being the fact that the crew of the Citation was wrong and unlike mictour, they took it like men, admitted that they were wrong and didn't lay blame, call names or try to "piss" people off!

The captain wouldn't know because he must have been with the team for sometime and for you to be with a fishing team you must be a fisherman. Nobody in the team would ever think he hasn't acquired a license, he might even be one of the best among them. Some unexplainable things happen sometimes... As crew your not a rich boat owner entering $10k tournaments, your working for a living on the guys $600K boat. And god obviously doesn't care and if there were an adult santa named god, i would expect him to be over looking after our troops, not watching the fishing tournament. Being we are at war with other god loving nut cases, it is pretty clear there is none. Yeah he has a plan for babies with aids or born addicted to crack and old ladies being raped and killed. You are the one that I feel sorry for. Darwin and Evolution has no basis on fact. Actually they are more of a religion by definition. Science themselves have proven Evolution wrong. Science shows that there at one time was a world wide flood and that by FACT the sun shrinks at constant rate of 3ft per hour. Now if the math is done there is no way the Earth can be over 9000 years old cause the sun would burn it up. Same way with the dust on the moon falls at a constant rate. When we first went to the moon the had huge pads with legs cause if the Earth was billions of years old the dust would be thick but it was not. Before you start talking about theories that apparently you haven't studied maybe you need to read them as a whole and not in part. So parts are believable but as a whole it is impossible. God does exist but people make our own decisions and we pollute what God has ordained. This is why our country was so great cause we was founded on God, but because we have hardened our hearts and turned away from him is why the country is in the shape it is in. Oh and for fact we don't believe the world started 5000 years ago. If you study the time line approx 5000 years ago was the flood. the Earth was here about 2000 years prior to the flood. As far as saying a lousy 15 or 30 dollars well they were on a 600k + boat so I am sure someone on that boat or the captain himself had the money. For some people it might make things tight but come on please try to be realistic.

If you're too full of yourself to pray don't worry, myself and many others are praying for you right now. You see I am not in need of something to believe in you are. I am just left with no other choice but the fact God showed up in my life and if you would take the time to see if there is a God or if science is all there is you might see what we see. It is plain and simple God is such that He allows you to make your plans shout them from the roof tops complain about His followers and cry. He will even let you die apart from Him if that is your wish. But if your wish is to know him, then He will draw close to you. He will bless you to no end. He will reveal His plan for your life. Darwin and Evolution have plenty of basis in fact. Just because there was a big flood at one time proves nothing. Many major religions have a flood story, so it's not unlikely there really was a big flood at one time. (Not necessarily of the epic proportions in religious texts, but pretty darn big to the survivors).
Your observation of the moon dust is an old argument that was debunked decades ago. The astronauts only SANK in it a few inches. If you walk down the beach and only sink 3 inches into the sand, that doesn't mean the sand is only 3 inches deep!
As far as the sun shrinking, you leave out a VERY important detail: The change in the sun's diameter is cyclical - predicted to be on a 76 year cycle - in which it shrinks and GROWS. Your analysis is akin to predicting that the mountain tops were covered with water (and therefore the Great Flood occurred) a certain number of years ago due to the fact that the tide went out and the level of the ocean dropped one foot at your vantage point.
Amazingly (or perhaps not so amazingly), YOU are the one that has not fully studied the theories you criticize. You are blinded by your belief and only internalize the bits and pieces that support your foregone conclusion.
I don't know what country you live in. I live in the USA and OUR country was NOT founded on God. The Islamic Republic of Iran was founded on God (Allah). Dandy society they have, eh?

They have buried bones for 5 years and carbon dated them and they show they are hundred of years old. Yet science still teaches these things as fact. Yes I do believe dinosaurs exist. One is because4 and science has proven this that at one time there was a water layer around the Earth and gave a greenhouse effect and that is why these animals grew larger and people live to be much older and was also taller. So you should really study up on your science and history. Like the other guy said. People that don't believe in God just try him. You say there is no God but yet you can't prove it because you have not looked for him. See I look for evidence why evolution is wrong. There is but one God and he died for everyone and rose again and defected death so that we may have life and more abundantly. I challenge you to test the theory and ask God to show himself to you. i must give it to the owners, captain, and crew of the citation there was speculation that they would file lawsuit if the big rock didnt announce the team winners, but the citation team made a public announcement they wouldnt due to the fact the money raised by the tournament goes to a handful of good causes and charities

What grounds would they have, they read and signed documents that they would abide be certain rules, they did not do so, let a detail slip, if anything they should be sued for not abiding by the rules and killing a rare fish for nothing and illegally. They should be banned from competing for years. And they are full of shit, they didn't file because they have no case but try to act like they are so giving and forgiving, lol. Kid they broke the rules, one guy or everyone, they as a team screwed up. And who was it that was speculating a lawsuit from an obvious loser of a case. No lawyer on the planet would take that on contingency is why. Pay them straight up cash and they will sue for anything. What possible grounds for a case could they possibly make. It is clearly stated what the requirements are and they failed to meet them. You can't put this off on the crew member, it is the captains job and responsibility.

Technically the rest of the team could have sued the guy without the license for negligence, but as was pointed out above there's no point to suing someone that doesn't have any money. Sure they'd win the judgment, but he could easily get it discharged through bankruptcy.

The license is a fishing license, not a weighing license, So when hearing he had the winning catch he made fast pace get his license online, again after the fish had been landed. Think this license would have been gotten if they weren't the daily winner?

He of all on board should have known and taken it upon hisself to insure his unit was ready and prepared. he failed the other men, not the other way around. An NCO in the military is given an article 15 for his squad or platoon not being ready and uniformed and equipted as called for, yet the college educated officers bound around like pompous idiots and take all the glory yet never actually in the guns site, calling in orders from the rear. You are no military vet or you would know and see that. Big internet talk there arnold, break you neck, lol Grow up little one.He failed his unit by not ensuring compliance to the rules not one of the victims for trusting to much. No military leader trusts, he leads by example, follows the rules and ensures everyone else does as well, he has inspections and makes sure his unit is ready, you dont trust someone brought the bait or the bullets./ And its not a world record kid it is a record for that particular tournament, hardly news worthy if it weren't for the loss of the prize money due to an idiot crew member and an even bigger idiot captain and team leader

They lock up all weapons as soon as you leave the range, they issue you keys to viechles, you don't keep one in your pocket. The military has nothing to do with trust and having that quality or instinct does not make you a better soldier, quite the opposite in fact. the thing that sucks about this the most is a fishing license does nothing more than bring revenue to the state. Its not like you have to take a test or anything. If these people were really smart, they would brush it all under the table for small $125 dollar fee, give the guys their DESERVED winnings and every one would be happy. But noooooo. I hate government sometimes.... for stupid shit like this. Over a $15 bull shit piece of paper.

Well in little league, the coach, me, had copies of each birth certificate. We were not even playing for $1M, just a $5 trophy. Maybe a better manager would have had copies????

I don't know how your state runs things, but in most, those funds from hunting and fishing licenses go straight to parks and recreations and such.

It does not matter if he was paid to work, this is a team tournament and clearly the rules said all must be licensed, duhhhh. Think before you run your hole. And yeah to the other self important jackass, the governement should send you all the bills and receipts to all it's spending to make sure you are passified. The money goes to protecting the rules, law enforcement on the water, parks and rec's etc as the other man stated. And what difference does it make, it is a rule and you have to follow em or pay the consequences or take over and install your own better more fair government. You think a $30 license fee is the worst we are being screwed when the federal income tax was a temporary measure for the war effort that never expired? Have a tea party like in Boston if you think it's unfair, just better have military grade group of personnel and equipment as most cities police forces have illegally. We are supposed to have no taxation without representation. Do they rich douchebag suits on capital hill really represent the common working man? There has not been a law written in more than 200 years that doesn't tell you what you can't do since the bill of rights which has been destroyed by amendments. Really people, you can be fined and jailed in areas for your lawn being to tall. Now suddenly in the name of keeping us free, we are now back to 1940's germany, show us your papers or we wisk you off till we know who you are. Now fighting in afganistan same as the russians for the same reasons but politics and not common sense made us help the enemy of our enemy, not just fight the real bad guys. The rules have nothing to do with the government, now had the Wildlife Resource Commision stopped the boat on the way back in then they would have fined him and made them release the fish. The work this guy was doing included baiting the rigs, casting out the troll lines, reeling in the lines to check the bait and re-baiting. Sorry guys but if you plop a rod in the water you are fishing. and lazy, even if he didn't need a license under NC State law, which he in fact did, the rules of the tournament specifically state that all captains, mates, and anglers must possess a NC coastal recreational fishing license. NC has strict laws that regulate how fish can be caught in the state, and thank God for that. The revenue from the licenses help pay the WRC officers that enforce out fishing laws, and help keep our waters clean. Yes the waters have been around for a million years, but if we let everyone do as they damn well please then they would be a cess pool and dickheads like mccabecj would just have another reason to wake up in the morning and bitch about the government. The anglers in NC respect the WRC and rules and regs that govern our coastal waters. So you enjoy all your "freedom" to do whatever you want in your coastal waters, I think I'll be ok paying 15 dollars a year to fish and actually be able to fish, and swim in the waters. Just don't come to NC when there are no fish let in your waters and the water looks like something that can out of a septic tank.

You are not a sportmem, nor a writer, so what are you? You stated, that you are holding your middle finger at the, "personal computer screen". After reading your coments and the amazing thought you put into it, I highly doubt that you upset anyone. You call people assholes while sitting alone giving the computer the middle finger and claim that you are listening as you set back (or do you mean sitting back while reading the forum?). Are you a leisure reader on topics involving outdoor sports? You seem to take an interest in the topic, since you posted a reply and chances are you will check back on your post to see if someone replied to it. If you are reading this posting, that I've put here, then you have something in common with the outdoors. You are the prey and we, the society of sportmen, are your predator. You could either, take a biology course or go observe the nature of wildlife, to understand what I mean by the rechecking of this post. If that wasn't an evolutionary trait found in wildlife (humans included), we (the human population) would not be here. Also, you seem educated enough to answer this, why do we have sharp teeth?

We are required to present our licenses to the capitan in the tournments we fish in Mexico and California. At least the guy didnt bring bananas on board, the marlin would have never made it to the gaff and he would have never made it to shore. You guys are champs in my book for getting an 800+ pound marlin on the back deck!!
