U.S. Supreme Court Confirms Surfco Beats FCS

SurfCo Hawaii, developer of Pro Teck Fins, is pleased to announce that the U.S. Federal Court litigation with FCS is finally over!

On October 26, 2001, the US Court of Appeals issued a mandate that the Pro Teck replacement fins for the FCS plugs, do not infringe the FCS patent. Shortly after this decision, FCS filed an appeal with the U.S. Supreme Court.

On June 24, 2002, the Supreme Court of the United States denied FCS’s appeal in its three-year lawsuit with SurfCo. This confirms that SurfCo is free to sell its fins that are compatable with the FCS system to anyone who has purchased a board with an FCS system. Evidence presented during the case indicated that the Pro Teck Fins are much safer, and also can result in improved performance. SurfCo also makes its fins for other systems besides FCS.

David Skedeleski, developer of Pro Teck Fins states: “It is unfortunate we had to go through this long and costly court battle, but we did it because I did not want to give up control of the Pro Teck Fins, that we developed because of my son’s nasty fin cut, to FCS. The real winners in this victory are the surfers who can now purchase Pro Teck Fins for any removable fin system and greatly reduce the risk of getting cut by their fins!”
